Visa & Permit Appeals – Overturn a Refusal
A refusal letter is not the end of the road – but the clock is already running. We read the refusal reasons line by line, collect the missing evidence and lodge a focused, well-argued appeal inside the deadline. We also help clients declared undesirable after an overstay.

Quick answer
How do I appeal a South African visa refusal?
Under Section 8 of the Immigration Act, you may ask the Director-General of Home Affairs to review or appeal a refusal, generally within 10 working days of receiving the decision. If that appeal fails, a further appeal to the Minister is possible within a similar period. The appeal must answer each refusal reason with evidence and argument – simply resubmitting the same documents rarely works. Once internal appeals are exhausted, a court review may be considered with an attorney.

04Make it count
What makes an appeal succeed
Answer every reason
Each refusal reason must be addressed directly with evidence – a general letter of complaint is not an appeal.
Add what was missing
If a document was absent or expired, the appeal is the time to provide it.
Use the law
Link your facts to the exact section and regulation the officer relied on.
Never miss the deadline
A late appeal may simply not be considered. Start on the day you receive the refusal.
05Fees
What does an appeal cost?
No fixed packages – fees reflect the real complexity of your matter, and you always know the cost before you commit.
There is no fixed price list on this site on purpose. The work behind an appeal depends on your category, your family, your paperwork and your history in South Africa, so a one-size price would either overcharge simple cases or under-prepare complex ones.
Your consultation is a paid, in-depth session with an experienced consultant – not a sales call. The consultation fee is confirmed when you book, before anything is charged, and you leave with real answers whether or not you go ahead with us. If you want us to handle the application, that work is quoted in writing before it starts. Government (Department of Home Affairs) and VFS Global fees are separate, set by them and paid directly.
Not sure you need a consultation? WhatsApp a short question to 072 561 3097 and we will tell you honestly whether you do. If a simple renewal is all you need, we will say so.
What your consultation gives you
- A full review of your documents and immigration history
- The exact visa or permit route we recommend, and why
- A personalised document checklist you keep
- Honest risks and realistic timelines – stated up front
- A written quote for any application work, with no obligation
What shapes the fee for your case?
Visa category
A visitor's visa extension is far simpler than a business visa or permanent residence.
Number of applicants
Spouses, children and dependants each need their own documents and forms.
Document readiness
Whether certificates, clearances, translations and apostilles are already in hand.
Case history
Previous refusals, overstays, undesirable status or a change of status add work.
Urgency
Tight deadlines – such as a 10-working-day appeal window – need priority handling.

10FAQs
Appeals FAQs
Straight answers to the questions our clients ask most.
How long do I have to appeal a visa refusal in South Africa?
Section 8 of the Immigration Act generally allows 10 working days from receiving the refusal to lodge an appeal with the Director-General. Contact us the day you receive the letter.
Can I stay in South Africa while my appeal is pending?
It depends on your visa status at the time of refusal. Some applicants are protected while an appeal is pending and others are not, so get advice immediately to avoid an overstay.
What if the Director-General rejects my appeal?
You may appeal to the Minister of Home Affairs within the time allowed. After that, a High Court review may be possible through an attorney.
Should I appeal or just reapply?
If the refusal reasons can be answered, an appeal is usually best. If the original application was in the wrong category or fundamentally flawed, a fresh application may be smarter. We advise after reading the refusal.
I overstayed and was declared undesirable. Can that be lifted?
Yes, you can apply under Section 30 for the undesirable status to be lifted, with evidence explaining the overstay – for example a pending application, illness or other good cause.
How long is the ban for overstaying?
Under the Immigration Regulations, an overstay of 30 days or less can lead to being declared undesirable for 12 months, and a longer overstay for five years. Upliftment applications can be made.
Can you guarantee my appeal will succeed?
No honest consultant can guarantee an outcome – Home Affairs decides. What we guarantee is an appeal that answers every refusal reason with the strongest available evidence.
What does an appeal cost?
It depends on the refusal, the evidence needed and the urgency, so we quote per case after reviewing your refusal letter.
